1. Acceptance of Terms

By engaging Apex Digital ("the Agency", "we", "us") for social media management services, you ("the Client") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Provided

Apex Digital provides social media management services including but not limited to: content strategy, content creation, caption and hashtag research, posting and scheduling, and account growth optimization across platforms such as TikTok, Instagram, Facebook, X (Twitter), YouTube, and Google My Business.

3. Client Responsibilities

The Client agrees to:

  • Provide timely access to social media accounts and necessary credentials
  • Review and approve content within a reasonable timeframe when requested
  • Provide accurate business information for use in content creation
  • Communicate any brand guidelines, restrictions, or preferences

4. Content Ownership

All content created by Apex Digital on behalf of the Client is owned by the Client upon publication. The Agency retains the right to showcase published work in its portfolio and case studies unless otherwise agreed in writing.

5. Results Disclaimer

While we strive for optimal growth and engagement, social media results are influenced by many external factors. We do not guarantee specific follower counts, engagement rates, or views. Past results showcased on our website are real but not indicative of guaranteed future performance.

6. Payment Terms

Payment terms, pricing, and billing cycles are agreed upon in a separate service agreement or proposal. Late payments may result in a pause of services until the balance is settled.

7. Termination

Either party may terminate the service agreement with 30 days written notice. Upon termination, the Agency will transfer all account access back to the Client and deliver any pending content.

8. Limitation of Liability

Apex Digital shall not be liable for any indirect, incidental, or consequential damages arising from social media platform changes, account restrictions imposed by platforms, or any third-party actions beyond our control.

9. Changes to Terms

We reserve the right to update these terms at any time. Clients will be notified of significant changes. Continued use of our services constitutes acceptance of the updated terms.
